Terms of Service

Bookly offers:

• Physical children's books
• Personalized and customized books (with names, photos, and custom messages)
• Downloadable and printable digital products
• Gift cards and related merchandise

All product descriptions, images, and specifications are provided for informational purposes. We strive for accuracy but cannot guarantee that all details are complete or error-free.

For personalized and customized books:

• You are responsible for providing accurate personalization details (names, photos, messages)
• Please carefully review all personalization information before submitting your order
• We are not responsible for errors in personalization caused by incorrect information provided by you
• Personalized products are custom-made and cannot be returned unless defective
• Production time for personalized books is typically 3-7 business days before shipping
• Photos provided must be of sufficient quality and you must have rights to use them

For downloadable and printable products:

• You receive a personal, non-transferable, non-exclusive license for personal use only
• You may not resell, redistribute, share, or commercially exploit digital files
• You may print products for personal use within your household
• All digital products remain the intellectual property of Bookly
• Unauthorized sharing or distribution may result in legal action
• Download links are valid for 30 days after purchase

• All prices are displayed in EUR (€) and include VAT as required by Spanish and EU law
• We accept payment through our secure payment processor (Stripe)
• Orders are subject to acceptance and availability
• We reserve the right to refuse or cancel any order for any reason
• Payment must be received before order processing begins
• You will receive an order confirmation email once payment is processed

All prices displayed on our website:

• Include Spanish VAT (IVA) at the applicable rate
• For EU customers, VAT is charged according to your country's rate where applicable
• For non-EU customers, prices exclude local taxes and customs duties
• We reserve the right to change prices at any time, but changes will not affect orders already placed

Physical Products:

• Shipping times vary based on location and selected method
• Standard shipping within Spain: 3-5 business days
• EU shipping: 5-10 business days
• International shipping: 10-20 business days
• Personalized products require additional 3-7 days for production
• You are responsible for providing accurate shipping information
• Risk of loss passes to you upon delivery
• Shipping costs are calculated at checkout based on destination

Digital Products:

• Download links are sent via email immediately after purchase
• Check your spam folder if you don't receive the email within 15 minutes
• Contact us if you experience download issues
• Links remain active for 30 days

Under EU consumer protection law, you have the right to withdraw from your purchase within 14 days without giving any reason, with the following exceptions:

Standard Physical Products:

• You may cancel within 14 days of receiving the product
• Products must be returned unused and in original condition
• You are responsible for return shipping costs
• Refund will be processed within 14 days of receiving the returned item

Exceptions (No Right of Withdrawal):

• Personalized/Customized Products: Cannot be returned as they are made to your specifications
• Digital Products: Once downloaded, the right of withdrawal is waived (you acknowledge this at purchase)
• Sealed Products: If opened, cannot be returned for hygiene reasons

Defective or Damaged Products:

• If you receive a defective or damaged product, contact us within 7 days
• Provide photos of the defect or damage
• We will offer a replacement or full refund, including return shipping costs
• This applies to both standard and personalized products

Incorrect Orders:

• If we send the wrong product, we will replace it at no cost to you
• For personalized products with our printing errors, we will reprint at no charge

Digital Products:

• Due to the nature of digital products, all sales are final once downloaded
• Refunds may be considered for technical issues preventing download or use
• Contact us within 48 hours if you experience technical problems

When you provide photos or content for personalized products:

• You confirm you own the rights to the content or have permission to use it
• You grant Bookly a license to use the content solely for creating your personalized product
• We will not use your photos or content for any other purpose without your explicit consent
• You are responsible for ensuring content does not violate any third-party rights
• We reserve the right to refuse content that is inappropriate, offensive, or violates rights

Under Spanish and EU consumer law:

• Products are guaranteed to be free from defects for 2 years from delivery (legal warranty)
• We are liable for defects that existed at the time of delivery
• Our liability is limited to the purchase price of the product
• We are not liable for indirect or consequential damages except where required by law
• Nothing in these terms limits your statutory rights as a consumer

If you have a complaint or dispute:

• Please contact us first at hello@booklystore.com to resolve the issue
• EU consumers can use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr
• These terms are governed by Spanish law
• Any disputes will be subject to the jurisdiction of Spanish courts
